1. About Curiouz and Our Platform

Curiouz operates as a curated online marketplace connecting buyers with authenticated vintage furniture, lighting, and design objects sourced from trusted dealers and specialists across Europe, the UK, and the USA.

Important: 

Curiouz acts as an intermediary between buyers and dealers. When you purchase an item through our Platform, you are entering into a sales contract directly with the dealer who owns the item. Curiouz facilitates the transaction, coordinates logistics, and provides customer support, but the dealer is the seller of record.

2. Eligibility

To use Curiouz and make purchases, you must:

Be at least 18 years old

Have the legal capacity to enter into binding contracts

Provide accurate and complete information during registration

By creating an account, you represent and warrant that you meet these requirements.

3. Account Registration and Security

Account Creation

To purchase items or access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information as needed.

Account Verification

Curiouz may request additional information or documentation to verify your identity. We reserve the right to approve or deny any account application at our sole discretion.

Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at info@curiouz.com if you suspect any unauthorized use of your account.

Account Termination

Curiouz reserves the right to suspend or terminate accounts for violations of these Terms, suspicious activity, or at our discretion. You may terminate your account at any time by contacting customer support.

4. Items and Listings

Item Descriptions

Curiouz works with dealers to provide accurate descriptions, photographs, and condition reports for all items. However, as all items are authentic vintage pieces (typically 40-80 years old), minor variations, wear, and age-appropriate imperfections are normal and are not considered defects.

Authentication and Verification

All items undergo a verification process before being listed on the Platform. While we make every effort to ensure authenticity and accurate descriptions, Curiouz does not guarantee that descriptions are entirely error-free due to the unique nature of vintage pieces.

Sold As-Is

Items are sold in their current condition as described in the listing. We encourage buyers to review all photographs, condition reports, and descriptions carefully before purchasing. If you have questions about a specific item, contact us at info@curiouz.com before completing your purchase.

5. Pricing and Payment

Pricing

All prices are displayed in the currency selected on the Platform (typically EUR, GBP, or USD). Prices do not include shipping costs, which are quoted separately after purchase.

Payment Methods

We accept major credit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, and bank transfer for high-value purchases. All payments are processed securely through Shopify Payments or our authorized payment processors.

Payment Security

Curiouz does not store your complete payment card details. All transactions are processed through PCI-compliant payment gateways.

Payment Disputes

If you have questions or disputes regarding payments, contact our customer support team at info@curiouz.com within 30 days of the transaction.

6. Shipping and Delivery

Shipping Process

After you place an order, Curiouz will provide a custom shipping quote within 24-48 hours. Items ship directly from dealer locations across Europe, the UK, and the USA. Once you approve the shipping quote, we coordinate delivery with our trusted courier partners.

Shipping Costs

Shipping costs are calculated based on item size, weight, destination, and delivery method. All shipping quotes are provided before you commit to the purchase.

Delivery Times

Estimated delivery times vary by origin and destination. Typical timeframes are 5-10 business days within Europe, 7-12 business days to the UK, and 2-4 weeks for intercontinental shipments. Exact timelines are provided with your shipping quote.

Insurance

All shipments are fully insured for their value. Curiouz coordinates insurance coverage and will handle any damage claims with the carrier.

Risk of Loss

Risk of loss or damage passes to you upon delivery and signature of the Proof of Delivery (POD), provided the POD does not indicate any damage.

Inspection Upon Delivery

Critical: You must inspect your delivery immediately upon receipt and report any damage or discrepancies within 48 hours to info@curiouz.com. Claims reported after this period may not be eligible for insurance coverage.

7. Taxes and Duties

You are responsible for all applicable taxes, including sales tax, VAT, import/export duties, and customs fees.

For EU deliveries, VAT is typically included in the purchase price. For deliveries outside the EU, import duties and taxes are the buyer's responsibility and are typically collected by customs upon entry to your country.

8. Returns and Cancellations

EU Consumer Rights (14-Day Cooling-Off Period)

If you are a consumer based in the European Union, you have the right to cancel your order without giving a reason within 14 days of delivery, in accordance with the EU Consumer Rights Directive (2011/83/EU).

To exercise this right:

1. Notify us in writing (email to info@curiouz.com) within 14 days of delivery

2. Include your name, order number, and reason for cancellation

3. Return the item in its original condition and packaging within 14 days

You are responsible for the cost of return shipping. Refunds will be processed within 10 business days of receiving the returned item. We may deduct from the refund any loss in value caused by handling beyond what is necessary to establish the nature and characteristics of the item.

Returns Outside the EU

For buyers outside the EU, returns are accepted within 7 days of delivery if the item is not as described or arrives damaged. The item must be returned in its original condition and packaging. Return shipping costs are your responsibility unless the item was damaged or incorrectly described.

Non-Returnable Items

The following cannot be returned:

Damage Claims

If an item arrives damaged, you must contact us at info@curiouz.com within 48 hours of delivery with photographs of the item and packaging. We will coordinate with the carrier and arrange for repair, replacement, or refund.

9. Import and Export Restrictions

Some items may require special permits for export from their country of origin or import to your country. You are responsible for determining whether permits are required and for obtaining them.

Curiouz makes no warranty regarding the availability or issuance of export or import permits. If you discover after purchase that permits are required and cannot be obtained within 30 days, you may cancel the purchase by providing written notice to info@curiouz.com.

10. Intellectual Property

All content on the Curiouz Platform, including text, images, logos, product photography, and software, is owned by Curiouz, our dealers, or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from Platform content without express written permission.

11. User Conduct and Prohibited Activities

You agree not to:

Use the Platform for any unlawful purpose or in violation of these Terms

Infringe on intellectual property rights of Curiouz, dealers, or third parties

Interfere with or disrupt the Platform or servers

Attempt to gain unauthorized access to any part of the Platform

Use automated systems (bots, scrapers) to access the Platform without permission

Submit false, misleading, or fraudulent information

Harass, threaten, or harm other users or Curiouz staff

User-Generated Content

If you submit content such as reviews, questions, or comments, you grant Curiouz a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display this content. You represent that you own or have rights to submit such content.

12. Privacy and Data Protection

Curiouz collects, uses, and protects your personal information in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR) and other applicable data protection laws.

By using the Platform, you consent to our collection and use of your personal information as described in our Privacy Policy, which is incorporated into these Terms by reference.

We implement appropriate technical and organizational measures to protect your personal data. However, no method of transmission over the internet is 100% secure.

13. Limitation of Liability

To the fullest extent permitted by law:

Curiouz, its officers, directors, employees, and agents shall not be liable for:

Indirect, incidental, special, consequential, or punitive damages

Loss of profits, revenues, data, or goodwill

Damages arising from use or inability to use the Platform

Third-party conduct or content on the Platform

Unauthorized access to your account or data

In no event shall our total liability to you exceed the amount you paid for the item that is the subject of the claim.

Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Curiouz, our dealers, and our respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from:

Your use of the Platform

Your violation of these Terms

Your violation of any rights of another party

Your violation of applicable laws or regulations

15. Dispute Resolution

Governing Law

These Terms are governed by the laws of Portugal and the European Union. Any disputes will be subject to the exclusive jurisdiction of the courts of Porto, Portugal.

Informal Resolution

Before initiating formal proceedings, we encourage you to contact us at info@curiouz.com to resolve disputes informally. We commit to working in good faith to reach a mutually acceptable resolution.

Arbitration (Optional)

If informal resolution fails, disputes may be resolved through binding arbitration in accordance with Portuguese arbitration law. Both parties must agree to arbitration in writing. The arbitration will be conducted in English in Porto, Portugal.

EU Online Dispute Resolution

16. Modifications to These Terms

Curiouz reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

We will notify registered users of material changes via email or Platform notification. It is your responsibility to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Curiouz regarding use of the Platform and supersede all prior agreements and understandings.

19. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms does not constitute a waiver of that right or provision.

20. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. Curiouz may assign these Terms or any rights hereunder without restriction.

21. Force Majeure

Curiouz shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.

22. Trade Program (Additional Terms)

If you are approved for our Trade Program, additional terms and conditions apply, including trade pricing agreements, payment terms, and sourcing services. These terms will be provided upon approval and form part of your agreement with Curiouz.
